Unauthorized Use

Post by dgrintalis on Tue Mar 30, 2010 10:41 pm

A poem of mine, Two Weeks in Spring, was recently published on Every Day Poets. Today, I get an email from someone at EDP letting me know that someone has copied my poem onto her blog, as part of her Touch-Up Tuesday - Creating a Tighter Poem. Did she ask my permission beforehand? Of course not. Considering this is a published piece, it's as tight as I want it in its original state. I've sent her a message asking her to remove it asap.

Here is the original piece: Two Weeks in Spring

And here is her blog post: Creating a Tighter Poem

I am livid. She did give me credit on her site, but she did not ask permission to post my poem, nor would I have given her permission to do so. Grrrr.....

That's pretty goddamn ballsy, to take it upon oneself to correct a piece of writing without the author's consent. I'd be pissed, too.

How very strange, that someone would use your poem as an example without permission. Some of her choices in the "edited" version were just CRAZY anyway. It appears she didn't mean to offend, but still...come on...... I'd be pissed off too.

Wow. That's just insane. I can't believe she thought it was a good idea to publically correct it! Let me help you kick her butt.

I think you should definitely blog about it, at the very least. I'll put on my devil horns and read it.

I posted a comment, but as she has comment moderation turned on, what do you think my chances are that she will actually approve it?

Oh, how very, very silly of her to do. I think it's downright disrespectful to publicly correct your work. It was frigging published, for fuxake! If she'd have discussed your poem, without the actual copying of text, it might be different. People talk about a writer's work all the time, after all. However, she copied, corrected (in her eyes) a published piece of work she has no right to. That ain't cool, at all. If it was just discussion, and conversational, I think it would be very different.

Approve it? No. Ah, but improve it? She might tighten it up and send it back to you. Wink

Arguably a copyright violation.

The right to create derivative works is part of the bundle of rights that belongs to a copyright owner.

Her "new and improved" version was crap! Her "tightening" strangled the flow of the entire poem. (Nice poem, btw.)

What I don't get is why this Lindsay Oberst person didn't take an early draft of one of her own poems and just show her own editing process? Why use someone else's? It's pretty arrogant for her to believe that a poem -- already published -- still needs to be tightened up! Jeez, if that were the case, I could take your average Stephen King novel and hack out 200 pages of unnecessary prose... but then that wouldn't be Stephen King, would it?

This is a perfect example of how some people feel they have license to use whatever they find on the Internet because it comes into their browser for free. As the Cowardly Lion would say: The noyve.

I love you guys. Thank you for supporting me in my ranting lividness. Is lividness even a real word? If not, it should be.

Lividness is a very Damien word.

And Kurt, I agree. She totally messed up the flow of that poem.

And she claims she is a writer, which makes it even worse!

What really chaps my hide is this poem was very, very hard for me to write (it's all sappy sweet, for one thing and totally unlike my usual poetry, which contains a lot of hurt...LOL) and it underwent revision after revision after revision (and then some) before I had it where I wanted it.

At least she was prompt in its removal. Didn't anybody ever complain before?

Bizarre. I missed this earlier, so unfortunately I'm left with the shitty version on Every Day Poets. sigh

Oh well. I'll take what I can get. It's very nice, by the way. I actually like how the flow is very tight (ironic, eh?) and crisp.

The least this "writer" could do is publicly apologize on her blog. Beyond that, some of you should publicly admonish her decision to do that in the first place. Don't be mean, of course, as she probably meant no harm, but it'd be a good opportunity to yet again collectively unite against this nonsense.

The Ridyard debacle and Paula's recent run in with a plagiarist are, I'm afraid, small indications of what will become a bigger problem in this Internet free-for-all era.

So strike back whenever you can.

No, no. That's okay. I like living with regrets.

By the way, I added a comment about it above. I hadn't read it when I first posted that.

I liked it. =)

Wow. That takes more balls than the world series and is more than just a little arrogant. Glad to see that she removed her post quickly when contacted. I can only imagine how insulting that is, after spending so much time carefully crafting your poem only for someone to come along as a self-appointed "fixer" and tell the world how your piece can be improved. Wouldn't her "edits" be nothing more than personal opinion?

Shoot I missed this yesterday. That sucks D! I did try to pop over to the other link and I couldn't get it. So whatever you did definitely shook the stupid out of her.

It takes a lot of gumption to change up someone else's work, WITHOUT even asking them. She's a peach eh?

And I do second Paula's comment. It's weird that someone took one of her poems only a couple of weeks ago, now... yours. It starts to make a writer shiver a bit. Not in a good way.

I remember this poem and it is sweet, and wonderful. I'm still glad for you that you got it published, and I'm even more happy now that the wrong has been righted. Even though that change what has been done.
